The Rader Group’s arbitration services would include standard arbitration procedures with the high expertise of the Former Chief Judge of the Federal Circuit who also broke significant legal ground as a sitting district judge. Beyond these standard services, however, the Rader Group would offer a streamlined new arbitration model that would reach reliable decisions more efficiently by using a technical and economic team to focus predominately on IP valuation.

With technical and economic experts as part of the Rader Group, it could allocate available royalties amongst various IP contributors to a product or feature. This might work well in a standards setting where the courts are simply not equipped to deal with large numbers of patents. This new arbitration method could also reliably assess the IP component of any single product and clarify that lawsuit liabilities could not exceed that cap, thus providing a manufacturer with “insurance” against royalty stacking.
