Although flexible to accommodate market demands and personal talents of its members, the Rader Group provides three primary services:

1) Arbitration and efficient decision-making alternatives.
2) China consulting to assist Asian companies’ entry and performance in the US market and vice versa for US companies confronting IP opportunities in Asia.
3) Educational conferences and meetings to address “cutting edge” IP topics in every world legal and economic market.

The Rader Group’s arbitration services would include standard arbitration procedures with the high expertise of the Former Chief Judge of the Federal Circuit who also broke significant legal ground as a sitting district judge. Beyond these standard services, however, the Rader Group would offer a streamlined new arbitration model that would reach reliable decisions more efficiently by using a technical and economic team to focus predominately on IP valuation. With technical and economic experts as part of the Rader Group, it could allocate available royalties amongst various IP contributors to a product or feature. This might work well in a standards setting where the courts are simply not equipped to deal with large numbers of patents. This new arbitration method could also reliably assess the IP component of any single product and clarify that lawsuit liabilities could not exceed that cap, thus providing a manufacturer with “insurance” against royalty stacking.

The China wing of the Rader Group would draw upon and include the services of Chinese-speaking experts who have spent decades living and working in China. Thus, the combined talents of the Rader Group would have the capability to propose plans that would solve corporate IP problems for both Asian and US corporations. For the Asian companies, the Group could advise on freedom-to-operate and litigation strategies that would ensure success in the US market.

Finally the Rader Group could assemble top talent to address any important IP issues in any jurisdiction in the world. These educational programs could be tailored to many varied corporate, judicial, or academic audiences around the world.

  • The Honorable Randall R. Rader,
